Terms and Conditions

Please read these terms carefully before booking. They set out the agreement between you and TimorGetaway, and they explain who is responsible for what.

Who we are

This website is operated by TimorGetaway, Lda., a company registered in Timor-Leste under company registration number 1439292, with its registered office at Travessa Lis Mutin, Delta 2, Comoro, Dom Aleixo, Dili, Timor-Leste. In these terms, “TimorGetaway”, “we”, “us” and “our” refer to TimorGetaway, Lda. “You” refers to the person making or named on a booking.

Acceptance of these terms

By browsing this website, making a booking, or accepting a booking confirmation from us, you agree to these Terms and Conditions, together with our Privacy Policy, Cookies Policy and Refund and Cancellation Policy. If you do not agree, please do not use the site or make a booking.

Our role

TimorGetaway is a booking platform. We work with independent local providers, including guesthouses, homestays, campsites, guides, boat operators, artisans, transport operators and conservation groups. When you book an experience or accommodation through us, we act as an agent facilitating that booking, and the experience itself is delivered by the provider.

We take responsibility for the accuracy of the listings we publish, for handling your booking and payment properly, and for supporting you if something goes wrong. We select and work closely with our providers, and we train them, but we do not own or directly operate their businesses. Where a provider is responsible for a failure, we will act on your behalf to resolve it.

Because many of our providers are small family businesses without websites or online systems, we manage the booking, communication and payment process on their behalf. This is a deliberate part of our model and is what allows community-based providers to reach international travellers at all.

Bookings
  • A booking request is not confirmed until we issue a written confirmation. Your booking becomes secure once payment has been received and verified, or, where you have chosen to pay in person, once we have confirmed your reservation in writing.
  • Payment deadlines are set out in our Refund and Cancellation Policy. If payment is not received by the applicable deadline and we have not agreed otherwise in writing, we may treat the booking as cancelled and release your dates.
  • You must be at least 18 years old to make a booking. Travellers under 18 must be accompanied by a responsible adult throughout the trip.
  • Bookings made on behalf of others. If you book for a group or family, you are the lead traveller. You confirm that you have the authority to accept these terms for everyone in your party, that you have passed on the information we provide, and that you are responsible for payment for the whole booking. We will communicate with you as the single point of contact.
  • You are responsible for the accuracy of the information you give us, including names, dates, contact details and any dietary, medical or accessibility requirements.
  • We may decline or cancel a booking where information is materially inaccurate, where payment is not received, or where we reasonably believe the booking is fraudulent.

Prices and payment
  • All prices are in United States dollars (USD), the official currency of Timor-Leste.
  • Prices are those shown at the time of booking. We may correct obvious pricing errors before confirming, and you may cancel without charge if we do.
  • Instant online payment gateways such as PayPal and Stripe are not yet widely available in Timor-Leste. We accept direct bank transfer, mobile wallet (Mosan by Telemor), P24, and payment in person at our office in Dili before your trip begins.
  • Where you pay by bank transfer, we provide account details and a unique booking reference. You may upload proof of payment through the website or send it to us by email or WhatsApp. We issue a written receipt for payments made in person.
  • Bank charges, transfer fees and currency conversion costs applied by your own bank are your responsibility.
  • Inclusions and exclusions are listed on each package page. Unless stated, prices exclude international and domestic flights, travel insurance, visa fees and personal expenses.

Changes, cancellations and refunds

These are governed by our Refund and Cancellation Policy, which forms part of these terms.

Your responsibilities as a traveller

You are responsible for:

  • Ensuring you hold a valid passport, any required visa, and any vaccinations or health documentation required for entry to Timor-Leste.
  • Arranging your own comprehensive travel insurance. TimorGetaway does not provide, sell or arrange insurance, and our packages include no cover of any kind. Your policy should cover medical treatment, emergency medical evacuation, trip cancellation, personal belongings, and specifically any adventure activities you intend to undertake.
  • Disclosing to us, before booking, any medical condition, disability, pregnancy or dietary requirement that may affect your participation or the arrangements we need to make.
  • Following the reasonable safety instructions of guides, boat operators and hosts at all times.
  • Respecting local customs, communities, cultural sites and the natural environment, including our Travel Responsibly guidance.
  • Behaving in a way that does not endanger, distress or offend other travellers, hosts or communities. We may end your participation without refund where behaviour is unsafe, unlawful or seriously disrespectful, and you will be responsible for your own onward costs.
  • Any loss or damage you cause to a provider’s property, which you agree to settle directly with them.

Activities, risk, health and accessibility

Some experiences offered through TimorGetaway involve inherent risk, including snorkelling, diving, boat travel, swimming, hiking and travel on unsealed roads in remote areas. Medical and emergency evacuation facilities in rural Timor-Leste are limited.

By booking, you acknowledge these risks and confirm that you are participating voluntarily and are in adequate health to do so. You must declare any relevant medical condition, and any inability to swim, before water-based activities. Providers may refuse participation on reasonable safety grounds, including weather or sea conditions, and no refund is due for an activity you are refused after failing to disclose a relevant condition.

Accessibility. Infrastructure in the municipalities where we operate is not yet suitable for persons with disabilities. Accommodation, pathways, beach access and sanitation facilities are not purpose-built for accessibility, and journeys involve rough roads, uneven ground and in some cases boat transfers. Please contact us before booking so that we can advise honestly on what may be possible.

Conservation, culture and community

TimorGetaway exists to support communities and protect the environment, and our terms reflect that. When taking part in our experiences you agree:

  • not to touch, stand on, break or remove coral, and to follow all instructions at coral nursery and reef restoration sites;
  • not to disturb, handle or obstruct turtles, nesting sites or other marine and terrestrial wildlife;
  • not to remove shells, coral, artefacts or cultural objects from any site;
  • to use reef-safe sunscreen where available, and to take all waste away with you;
  • to ask permission before photographing or filming individuals, particularly children, and to respect a refusal;
  • to dress and behave respectfully at churches, sacred sites and in village settings;
  • to treat homestays as the private family homes they are, observing the household’s routines, and to remember that your hosts are welcoming you into their home rather than operating a hotel.

We may end your participation without refund where conduct causes serious damage to the environment, to cultural property, or to a host community.

Limitation of liability

We accept liability for our own negligence and for our failure to perform the services we have agreed to provide. Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded.

Subject to the above, we are not liable for:

  • the acts or omissions of independent providers, other than where we have failed to exercise reasonable care in selecting or working with them;
  • loss or damage caused by events beyond our reasonable control, as described in Section 11;
  • indirect or consequential loss, including loss of enjoyment beyond the value of the affected services, loss of earnings, or the cost of separately booked flights, visas or accommodation;
  • loss, theft or damage to your personal belongings, which remain your responsibility throughout;
  • any loss arising from your failure to disclose a relevant medical condition, or from your failure to follow safety instructions.

Where we are liable, our total liability in respect of any booking is limited to the total amount you paid to TimorGetaway for that booking.

Events beyond our control

We are not liable for any failure or delay in performing our obligations where that failure or delay results from events beyond our reasonable control, including severe weather, sea conditions, flooding, road closure, natural disaster, fire, epidemic or pandemic, public health measures, civil disruption, strike, government action, or the failure of transport or utility services. Where such an event affects your booking, our Refund and Cancellation Policy sets out what we will offer.

Complaints

If something goes wrong, please tell your host or our team immediately so that we can put it right while you are still with us. The full complaints procedure, including timescales, is set out in our Refund and Cancellation Policy.

Intellectual property and your content

All content on this website, including text, photographs, video, logos, package descriptions and design, is owned by TimorGetaway or used with permission, and may not be reproduced commercially without our written consent. Photographs of community members and providers are published with their consent and must not be reused elsewhere.

If you share photographs or reviews with us, or tag us on social media, you grant us a non-exclusive, royalty-free licence to reproduce that content in our marketing, with credit where practical. You may withdraw this by contacting us.

Reviews you submit must be your own honest experience. We may decline to publish, or remove, content that is abusive, discriminatory, unlawful, or that identifies individuals without their consent.

Website content and availability

We work to keep listings, prices and availability accurate, but content may occasionally be out of date or contain errors. We may change or withdraw packages, and we may suspend the site for maintenance. Third-party links are provided for convenience and are not under our control.

Your personal information

How we collect, use and share your information, including the details we pass to your hosts so they can prepare for your arrival, is set out in our Privacy Policy.

General

Severability. If any part of these terms is found to be unenforceable, the rest remains in force.

Entire agreement. These terms, together with your booking confirmation and the policies referred to here, form the whole agreement between us.

No waiver. If we do not enforce a term on one occasion, that does not prevent us from enforcing it later.

Assignment. You may not transfer your booking to another person without our written agreement. We may transfer our rights and obligations under these terms to another business, provided your booking is not adversely affected.

Language. These terms are published in English. Where a translation is provided for convenience, the English version prevails.

Changes to these terms

We may update these terms from time to time. The version in force at the date of your booking confirmation applies to that booking. The current version is always published on this page with its last updated date.

Governing law and disputes

These terms are governed by the laws of the Democratic Republic of Timor-Leste, and the courts of Timor-Leste have jurisdiction over any dispute. Before commencing formal proceedings, both parties agree to attempt to resolve the matter in good faith through direct discussion.
